This website offers visitors product for purchase as well as information directly or indirectly associated with those products. COMMERCIAL TERMS

 

The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

 

When buying an item for this Site, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process. (iii) If you choose to enter in a subscription contract, the fee for the products and any other charges incurred in connection with your purchase, such as taxes and shipping fees, will be charged on recurring basis, based on the terms of your subscription, to the payment method provided for this purpose until your contract expires or you cancel your subscription.

 

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

 

NO WARRANTIES

This Website is provided “as is,” with all faults including, but not limited to typographical errors, pricing errors, and inaccurate information resulting from human error or mistaken information provided by vendors and other third parties. Hoist and Crane Coffee makes no express or implied representations or warranties, of any kind related to this Website or the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you. In the event a product is listed at an incorrect price or with incorrect information due to typographical error, Hoist and Crane Coffee shall have the right to refuse or cancel any orders placed for such product, whether or not the order has been confirmed and a charge has been made. If your payment has already been processed and your order is canceled, Hoist and Crane Coffee shall immediately issue a refund to your original payment method for the amount charged.

 

 

LIMITED LIABILITY

In no event shall Hoist and Crane Coffee, nor any of its officers, directors and employees, be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website, whether such liability is under contract, tort or otherwise.

REMEDIES

You agree that Hoist and Crane Coffee's remedy at law for any actual or threatened breach of this Agreement would be inadequate, and that Hoist and Crane Coffee shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that Hoist and Crane Coffee may be legally entitled to recover, including any reasonable expenses incurred in the the resolution of any dispute, including, without limitation, attorneys' fees. No right or remedy of Hoist and Crane Coffee shall be exclusive of any other, whether at law or in equity, including without limitation damages injunctive relief, attorneys' fees and expenses. No instance of waiver by Hoist and Crane Coffee of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future or other waiver.

 

GOVERNING LAW

This Site is created, owned and managed by Hoist and Crane Coffee in the state of Rhode Island, USA. These Terms will be governed by and construed in accordance with the laws of the State of Rhode Island, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Rhode Island for the resolution of any disputes.

 

PROPOSITION 65 WARNING
